The Equality Act - at a glance

The Equality Act 2010 introduced 20 key changes to Equality Law in the UK. We view the following 5 main areas of change as priority issues that should be addressed by private and public sector employers:

  • New Definitions of Discrimination - which means that your organisation must embrace the concept of "protected characteristic", associative and perceived discrimination, as well as direct and indirect discrimination.
  • Fundamental Changes to Disability and Discrimination Law - there are key changes to the definition of a disabled person, aimed at reducing the gap between discrimination arising from disability and indirect disability discrimination. Beyond that, the Act makes a key change in how your organisation can enquire about disability and health.
  • Voluntary 'Positive Action', allowing your organisation to make 'tie-breaker' decisions.
  • New Provisions on Equal Pay - this has lead to a new employer's defence and increased Gender pay gap information, as well as barring pay secrecy clauses.
  • For those in the Public Sector, the New Public Sector Equality Duty is being introduced, together with Government proposals for specific duties (and implications for public procurement).
